IU Faces Class Action Lawsuit For Ongoing Mold Issues

Indiana University faces a class action lawsuit in regards to a mold infestation affecting students living in two residence halls on campus.

The complaint was filed October 17.

It lists seven plaintiffs, all who are freshman residents in McNutt and Foster dormitories.

It alleges that the university didn’t respond to repeated requests to address the mold problem and refused to provide detailed information to the plaintiffs and their families regarding the nature of the mold or steps to remediate the problem.

The plaintiffs served the university requests for production of the documents on Oct. 18.

The plaintiffs then requested that the court shorten the university’s time for response, ordering that the documents are delivered no later than Oct. 29.

The complaint claims IU officials said they “did not have time” to provide the documents and would not provide documents until Nov. 19 or later.

IU officials say the university had more than 833 calls about mold and as of last week c ompleted 826 initial inspections.

The university has compensated affected students with $3,000 bursar credits.

Although the university has worked to fix the issue, the lawsuit alleges that the university has only attempted to clean the mold in dorms on a piecemeal basis without following proper procedure.

The document calls for the reimbursement for damages caused by the university, injunctive relief and declaratory judgement.

IU officials declined to comment on the pending litigation.
