Indiana’s Court of Appeals ruled in favor of IU in an appeal of a class action lawsuit filed by students who lived in dorms where mold was found. The court sent the case back to Monroe County Circuit Court for further action.
In 2018, the seven plaintiffs sued the university claiming it didn’t do enough to remove mold found in the Foster and McNutt dorms.

Neither residence hall was used during the 2019-2020 school years while renovations were made. Students were housed in other dorms during that time.
The University had sought summary judgment in the case but that was denied by the lower court; the University appealed.
Judge Terry Crone ruled that the university properly compensated the students affected by the mold, when it credited the bursar accounts of 2,458 students for a total of $7.3 million.
The Indiana Tort Claims Act caps compensation at $5 million.
