Two Indiana men plead guilty to Jan. 6 riot charges

Two men from Indiana pleaded guilty on Thursday to assaulting law enforcement during the Jan. 6, 2021, breach of the U.S. Capitol.

Donald Lee Moss, 62, of Elizabethtown and James Link Behymer, 61, of Hope each pleaded guilty to one felony count of assaulting, resisting, or impeding certain officers. They will be sentenced on Feb. 13, 2025.

According to court documents, Behymer and Moss approached police officers and were told to step back. Behymer raised his right arm and chanted “USA! USA! USA!” At the same time, Moss pointed at the Capitol building and shouted, “This is our f---- house!”

When an officer attempted to keep Behymer back with his hand, he struck the officer’s wrist. Moss, after forcing the officer’s hand off Behymer, pushed another officer from behind.

Ten minutes later, Moss and Behymer entered the U.S. Capitol. Moss stood at a shattered window and waived other rioters inside. They later exited and re-entered the building before leaving.

Since Jan. 6, 2021, more than 1,500 people have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol. That includes more than 560 people charged with assaulting or impeding law enforcement.
