Motion filed to dismiss charges against Sean Purdy, one of the men charged In July 4th incident for attacking Booker

The lawyer for Sean Purdy, one of the men  charged with criminally confining, battering and intimidating Bloomington activist Vauhxx Booker, filed a motion to dismiss Purdy’s case Tuesday. 

The special prosecutor for the case, Sonia Leerkamp, originally planned to use restorative justice for the case, to keep it out of court, at the suggestion of Purdy’s lawyer David Hennessy. But the two sides could not agree on terms of restoration. 

The Supplemental Memorandum filed by Hennessy says Purdy did what was required in the restorative justice process.

It also states that the day after that process was initiated, Hennessy emailed Leerkamp and others involved, including Booker’s attorney Katherine Liell, that the expected resolution would be dismissal of charges for his clients, and that this expectation was not disputed.

Booker has said that he originally agreed to participate in the restorative justice process, but later decided to back out. He said he was asked to sign a confidentiality agreement and agree not to pursue charges against Purdy and Chris Cox, another man charged in the Lake Monroe incident.

Booker also said the process would have required him to participate in a news conference where he would publicly forgive Purdy and Cox.

In July 2021, Leerkamp announced charges of misdemeanor trespass and felony battery against Booker for his involvement in the 2020 Fourth of July incident.
