Lawyers ask to add Kilroy's Sports to wrongful death suit

Attorneys for the parents of the IU freshman who was killed when he was hit by a car while riding a scooter, want to add Kilroy’s Sports Bar to their civil lawsuit.

The suit was filed by the parents of Nathaniel Stratton in December against Madelyn Howard, who was driving the car. She’s been charged in criminal court with three felonies, including operating a vehicle while intoxicated resulting in death.

The Strattons' lawyer in the civil case, Fred Schultz, said Howard was at Kilroy’s Sports, where staff continued to serve her after she was visibly intoxicated. 

“In this case, with this set of facts, knowing that she had just left, knowing what her BAC level was at the scene when she stopped just moments later, and the terrible events that happened in between," he said. "We feel like it's a very strong case."

The Indiana Dram Shop Act passed in 1986, says bars and night clubs can be held accountable for serving alcohol to someone who is visibly intoxicated. 

Schultz said they’ve filed a motion to add Kilroy’s Sports Bar to the civil suit and are waiting on approval.
