Bloomington man found guilty of raping IU student who died from overdose

A Bloomington man was found guilty Friday for charges connected to the rape and death of an IU senior last August. 

The jury deliberated five hours before convicting Eric Montgomery of rape, attempted obstruction of justice, and furnishing alcohol to a minor. 

Twenty-year-old Avery McMillan died of a fentanyl overdose at Montgomery’s home last August.  

Montgomery said that, earlier that evening, the two met near campus and he took her to his house. 

The next morning, McMillan was unresponsive. 

Montgomery called emergency services, but Sheriff’s deputies were unable to revive McMillan using Narcan. 

He will be sentenced Aug 4 and faces up to 39 years in prison. 

Montgomery was investigated earlier this year by Ellettsville police for an alleged rape in 2021. The Indiana State Police Crime Lab says his DNA matches a test kit collected from the earlier victim.
