Richard Allen, convicted of killing Delphi teenagers Abigail Williams and Liberty German in 2017, will be sentenced Friday. He faces up to 65 years in prison for each of the four murder counts.
In a court filing Thursday, Allen’s attorneys said he did not participate in the pre-sentence investigation that the judge considers.
The filing states there’s no value in Allen talking with “State actors” who violate his constitutional rights.
The lawyers said they will appeal Allen’s conviction.
Allen’s attorneys also state double jeopardy prevents him from being sentenced on both murder and felony murder convictions when the crime involves the same victim, which is why they’re requesting the court vacate the felony murder convictions.
Allen’s legal team also noted that Allen has no prior criminal history, served almost a decade in the National Guard and has a history of mental illness.
Prosecutors will hold a press conference after the sentencing. This will be the first time in two years the family will be allowed to speak publicly on the case because of the judge’s gag order.
As of Thursday afternoon, more than a dozen people were lined up outside of the Carroll County Courthouse to attend the sentencing. The courthouse doesn’t open until 8 a.m. Friday.
