Monroe County says Rokita shouldn’t get third chance to advance immigration lawsuit

Monroe County filed a motion to dismiss a lawsuit from state Attorney General Todd Rokita.

Rokita filed the suit against the sheriff’s office last summer, claiming it violates state law by preventing officers from sharing someone’s immigration status with federal agencies.

A motion to dismiss filed last Friday states Rokita’s amended complaint does not provide any new facts to prove the sheriff’s office violates state law.

“Rather than using the opportunity to amend as a chance to add allegations that would fix the core deficiencies in his complaint, the Attorney General has simply recycled arguments that this Court has already deemed insufficient and unpersuasive,” county lawyers said in the filing.

County lawyers also said the attorney general should not get a third attempt at advancing the lawsuit.
