Bloomington Still Trying To Acquire JuanSells.com Building

The City of Bloomington is still going after the JuanSells.com building.

In a motion filed Dec. 30, the city is asking the Monroe County Circuit Court for permission to amend its original attempt to use eminent domain to acquire realtor Juan Carlos Carrasquel’s building on the corner of 3 rd and Walnut.

Monroe Circuit Court Judge Holly Harvey previously ruled the city could not take Carrasquel’s building through eminent domain to expand the proposed Fourth Street Parking Garage because the original proposal included space for first floor retail. That space would not be used exclusively for public use, so Harvey ruled the city unable to take the space.

The city’s request says it “no longer intends to include nonresidential retail space as part of the Project,” and instead plans to use the space solely as a parking garage.  

Carrasquel, who did not respond in time for comment, filed a notice the day after saying he will object to the motion but has not yet filed that objection.

He has until Jan. 29 to do so.
