New State Law Allows Increased Cell Phone Tower Construction

A recent change in state law allows companies to place cell phone towers on a property owners' utility easements.

Bloomington's Assistant City Attorney Patty Mulvihill says the statewide standards mean cities have no choice but to give companies access to right of ways.

"So, in simplicity, they basically said, ‘This is the statewide universal policy that we're going to use, local governments you're going to have to live with it," she says.

Mulvihill says the city cannot flat-out stop this, but they did pass an ordinance in April to have some control over the placement of the towers. She says citizens have expressed concerns about the installation of the towers.

"I think some people are concerned that there are possible negative health impacts," she says. "There's not really been long term studies on these and generally, I think some people are upset that it was passed by the General Assembly without what they would consider to be real public input from local units of government and citizens."

Mulvihill says the best way for concerns to be heard is for citizens to write to their legislators.
