Hearing held for man who pled guilty to the murder of 12-year-old son

State prosecutors asked for the maximum sentence for Luis Posso Jr. during a hearing Friday at the Monroe County Justice Center. 

Posso and his wife, Dayan Medina Flores, were arrested in May of 2019 after Posso brought his bruised and emaciated son, Eduardo, to IU Health Bloomington Hospital, where the child was pronounced dead. 

Posso previously pled guilty to murder in June as a part of a plea deal with the prosecution. With this deal, the prosecution dropped the neglect, criminal confinement and battery charges against him. In addition, the life without parole enhancement will be dismissed and federal charges will not be pursued. 

The state wants Posso sentenced to 65 years, citing immense harm Eduardo suffered, other minors present during the offense, and Posso’s custody of the victim.  

The defense is asking for the minimum 45-year sentence with some type of probation. Posso, they said, would respond to probation in the short term and believe he has shown remorse both in the past and now.

A police investigation found that Posso and his wife had locked Eduardo in the bathroom, refused to feed him and shocked him with a dog collar. 

The case is being taken under advisement and another sentencing hearing will be set at a later date.
