Man arrested in connection to death of IU student

Update: 8/31/2022 

The Monroe County Sheriff's Department is investigating the death of a 20-year-old Indiana University student from Valparaiso.

Avery R. McMillan was found unresponsive August 17 at a home in the 4100 block of Arlington Road. Deputies administered three doses of Narcan, but McMillan did not survive.

The 911 call came from a Eric Montgomery, a 33-year-old man who lives at the property, and claimed he met McMillan on the night of August 16th near the IU Campus. The two went back to his home, and he found her unresponsive the next morning.

The sheriff’s department said he had been cooperating with detectives.

On August 30, detectives with the Sheriff's Department obtained a warrant for the arrest Montgomery on charges of rape and furnishing alcohol to a minor.

Because of Montgomery's prior criminal history, a Critical Incident Response Team assisted with the arrest. Montgomery was taken into custody during a traffic stop and jailed.

Monroe County Sheriff Brad Swain announced the student's death August 18. An autopsy was scheduled the same day.

Update: A previous version of this story said McMillan was found Thursday morning. She was found Wednesday morning, and met the 33-year-old man Tuesday evening.  A previous version of this story said the victim was 21.
