Man linked to death of student faces new charge for 2021 rape

A Bloomington man charged with the rape of a drugged IU senior Avery McMillan who died last August is facing new charges in a 2021 rape case. 

According to court documents, an Ellettsville woman accused Eric Montgomery, 33, of sexually assaulting her on Aug. 21, 2021.  

The woman reported the rape to Ellettsville police that same day and submitted a sexual assault evidence collection kit to the state crime lab in Indianapolis. 

She identified Montgomery as her next-door neighbor and said she allowed him into her apartment because he was distraught about the death of a family member. 

According to the victim, Montgomery asked for a hug and lay with her in bed. The victim consented to the hug, but Montgomery began sexually assaulting her despite her telling him to stop multiple times. 

On Sept. 1, 2022, slightly more than a year after the victim came to the police and 11 days after the assault and death of McMillan, Ellettsville police applied for a warrant to take a sample of Montgomery’s DNA. They obtained the sample the next day, and the state crime lab was able to confirm a match by Jan. 3. 

The reason for the delay, and whether the timing of the warrant was related to the McMillan case, are unknown. The Ellettsville Police Department could not be reached for comment in time for the publication of this article.
