A Bloomington man convicted on three counts in connection with the death of IU senior Avery McMillan was sentenced to 36 years today.

Eric Montgomery will serve 15 years for rape, 180 days for providing alcohol to a minor and two years for obstruction of justice. The first and second sentences will be served concurrently. Additionally, he has a consecutive offender enhancement from a prior burglary conviction, adding 19 years to his sentence.
McMillan, 20, died of a fentanyl overdose at Montgomery’s home on Aug. 17, 2022. Montgomery said the two met near campus earlier that night, and he took her to his house.
Montgomery’s case regarding the rape of an Ellettsville woman is still pending, according to the Monroe County Prosecutor’s Office.
