The City of Bloomington will pay more than $62,000 in legal fees after failed eminent domain attempts with JuanSells.com Realty.
The city wanted to expand the footprint of the new Fourth Street parking garage onto Juan Carlos Carrasquel’s land south of the current site.
City officials tried to acquire the land this past year through eminent domain litigation but Monroe County Circuit Judge Holly Harvey ruled twice against the city because plans called for retail space on the ground floor, which is not a public purpose.
Carrasquel sought legal fees over the case. Harvey this week ordered the city to pay $62,250 within 30 days.
Fourth Street Garage construction is underway with a new, taller design. It’s expected to be complete by next summer.
