Group asking judge to delay annexation hearing on remonstration

A group against Bloomington’s annexation is asking a judge to delay their court date after the remonstration results in February of 2022.

City council members adopted seven areas two years ago to be annexed into the city. Five of those areas successfully voided the city’s annexation through remonstration.

Areas 1A and 1B didn’t meet the criteria to void annexation but did reach the 51+ percent threshold to appeal annexation in court. Those areas are west and southwest of the city.

The city filed a lawsuit as well claiming the remonstration effort was unconstitutional due to a 2019 state law that took effect after the city’s initial annexation attempt.

Pushing City Limits: Bloomington Annexation Coverage

Members of County Residents Against Annexation say the court should wait for the outcome of that case as a decision could render their case moot costing the group more legal and court fees.

The city argues that either way the Monroe Circuit Court will have to hear the group’s case and that they’re putting off the court date to delay annexation.

Judge Nathan Nikirk is presiding over the case and didn’t specify when he will make a ruling.

The date for a Bench Trail is scheduled for November 13.
