New charges filed in former teacher sexual assault case

Five more minors have been included in additional felony charges in a sexual assault case against a former teacher from Martinsville. 

Preliminary charges against Brittany Fortinberry, 31, include three charges of sexual misconduct with a minor, dissemination of harmful material to minors, and contributing to the delinquency of a minor. 

The case investigator filed last week for those charges to be amended and for new charges, which include: 

  • 10 counts of child molestation 
  • 1 count of sexual misconduct with a minor 
  • 8 counts of supplying harmful material to a minor 
  • 5 counts of contributing to the delinquency of a minor 

The Morgan County Sheriff's Department said in the latest probable cause affidavit that these charges span from January 1, 2022 to December 31, 2024. 

Victims include students from Eminence High School, where she worked. The youngest in the probable cause affidavit was 13 years old at the time.  

Interviews with the investigator describe Fortinberry drugging them with mushrooms, marijuana or alcohol before having sex with them.
