Attorneys Seek To Have Lake Monroe Zoning Suit Dismissed

Lawyers for a Monroe County Man accused of violating zoning laws filed a motion to dismiss the county’s lawsuit against him.

An attorney for the firm Taft, Stettinius and Hollister said in a court documents, Monroe County is trying to enforce “Phantom Zoning and Building” violations against Joe Huff.

The county sued Huff in May after he began logging on his property adjacent to Lake Monroe.

According to court documents, County Attorney David Schilling told Huff he had to obtain an “improvement location permit” after heavy machinery was observed on his property.

Huff’s attorney’s claim Schilling never told their client he needed two other permits for land use and erosion control.

Schilling did not respond to an email and phone call placed by WFIU/WTIU News.
