Jennings County deputy will not face charges for using deadly force

A Jennings County deputy will not face charges for using deadly force during a February arrest.

County prosecutor Brian Belding released his findings Tuesday based on an Indiana State Police investigation into the death of 29-year-old Devin Lark.

Lark was wanted for seven counts of burglary, auto theft, theft, and battery. Lark also had an arrest warrant in Clark County for dealing a narcotic drug.

Lark ran from authorities upon their arrival Feb. 3; Deputy Cody Low’s K-9 partner, Axel, apprehended him.

State police used body cameras, officer statements, and evidence at the scene to determine Lark was holding a firearm during a struggle with Low.

Lark did not comply with commands to drop the weapon. During the struggle, Low said, “I’m gonna kill you.” Lark responded, “kill me, kill me.”

Low fired one bullet through Lark’s chest. Toxicology reports revealed illegal substances in Lark’s blood.

The prosecutor’s findings say Low acted without fault and was justified in using deadly force in the defense of himself and other law enforcement officers.
