Prosecutors request hearing for two insurrection suspects

Two Indiana men will appear in court after being arrested on insurrection charges stemming from events at the U.S. Capitol building on Jan. 6, 2021

The U.S. District of Columbia District Court is requesting an arraignment and status conference. A D.C. attorney filed an indictment May 9.  

James Behymer, 61, of Hope, and Donald Moss, 62, of Elizabethtown were arrested on March 6 on six charges, including civil disorder, assaulting or resisting officers, and entering a restricted building. Moss is facing an additional charge for forcibly interfering with an officer. 

They were identified through their cell phone information, both 812 area code numbers.  

A witness who worked with the two confirmed their identities with Capitol security and officer body camera footage.  

Moss was arrested in Bloomington and Behymer was arrested in Hope. 

The two were seen on body cameras in a group that attacked officers.  

The criminal complaint said Behymer struck an officer’s arm and grabbed a baton from another officer. Moss was seen on body cam footage shoving another officer with his arm. 

The two entered through the Senate Wing Doors to the U.S. Capitol Building around 2:13 p.m.,  

Moss was seen moving a chair to block a retractable door in the Crypt Lobby East. Moss exited through a window near the Senate Wing Doors around 2:41 p.m., with Behymer also leaving two minutes later. 

Both re-entered through the Senate Wing Doors around 2:50 p.m. after rioters broke through a barricade. Moss picked up a sign with the phrases “No lockdown” and “No mask” while inside, and could be seen with the sign when the two left around 3:34 p.m. 

Both were in the Capitol for more than an hour. 

More than 1,300 individuals have been charged for Capitol breach crimes.
