A judge has granted former Secretary of State Charlie White reprieve from serving his one-year home detention sentence while he appeals convictions of voter fraud.
A jury convicted White of six criminal counts of voter fraud in 2012. Those included submitting a false voter registration application, two perjury counts, voting in another precinct, casting a false ballot and theft.
Judge Steven Nation then named them each class D-felonies and sentenced White to one year of home detention, a $1,000 fine and community service.
As the IndyStar reports, White will have to serve his full sentence if he loses the appeal.
White was scheduled to start serving his sentence by Jan. 10 after Hamilton Superior Court Judge Daniel Pfleging denied White's claims for post-conviction relief.
White spent last year arguing in court that he shouldn't have to serve his sentence because his former defense attorney, former Marion County Prosecutor Carl Brizzi, was incompetent. White said Brizzi's failure to call any witnesses to testify in White's defense led to his convictions.
Pfleging said in a decision earlier this month that White could not make a case for Brizzi's incompetence.
