A Marion County court ruled Monday the State is not responsible for assuming the liability of or defending the company that provided the stage equipment that collapsed at the Indiana State Fair in 2011.
Marion County Superior Court 2 Judge Theodore Sosin ruled against Mid-America Sound Corp. and in favor of the Indiana State Fair Commission.
Mid-America Sound Corp. claims since they were contracted by the State, the State should financially assume the company's civil liability and legal defense.
Attorney General Greg Zoeller denied this claim and said in a statement:
"Victims of the State Fair tragedy still can pursue this company for a judgment in civil court, but the court made it clear that the company cannot transfer or shift its liability or legal expense to the State and taxpayers. This is an important ruling that upholds the prohibition set in statute that the State cannot indemnify a private company."
Seven people died and many were injured in the collapse.
