An Indiana attorney says the Daviess County Clerk was likely in contempt of court for refusing to process marriage licenses for same-sex couples before a stay on the same-sex marriage ruling took effect.
Sherri Healey‘s office said she planned to continue denying licenses to same-sex couples for religious reasons after a federal judge struck down the same-sex marriage ban.
After a federal judge granted the stay on Friday to halt same-sex marriages, Indianapolis attorney John Tompkins says Healey was still in contempt of the court.
According to Tompkins, the stay on the ruling should not be a way to for Healey to escape responsibility for her actions.
"I hope she's held accountable- even if that bails her out- for failing to do it in the time that she's legally bound to do it," he says.
Tompkins says Healey could face jail time, depending on the judge, if she is charged.
