Appeals Court Upholds Dismissal Of Lauren Spierer Lawsuit

A federal appeals court upheld a ruling to dismiss a  lawsuit filed by missing Indiana University student Lauren Spierer's parents.

The decision, issued Friday, comes more two years after Robert and Charlene Spierer filed the civil negligence lawsuit against Corey Rossman, Jason Rosenbaum and Michael Beth.

The Spierers filed the lawsuit alleging the men had been negligent in providing Spierer with alcohol after she was intoxicated and owed her a "duty of care" the night she disappeared. Attorneys for the men denied the allegations.

In the ruling, the appeals court said:

Despite Lauren's visible intoxication, the facts do not establish that defendants had the right or ability to control her movement to such a degree as to force her to remain in a certain place...We have found no decisions under Indiana law where persons were held liable for the actions of their social peers, absent additional factors not present here.

Lauren Spierer went missing June 3, 2011. Her disappearance remains under investigation
