Jared Fogle's defense team has been granted a 25-day extension on the deadline to submit an appeal to Fogle's sentence.
Ronald Elberger, Fogle's defense lawyer, filed the request on Wednesday. He cited severe health problems due to prostate cancer as well as deadlines in January and February for other cases in which he is involved.
In the court documents, Elberger states that he has enlisted the help other attorneys to assist him in the preparation of the appeal.
"Just in case any medical situation again arises that impedes my ability to complete the work required," he states.
The federal court in Indianapolis granted the extension Wednesday.
In November, a judge sentenced Fogle to 15.5 years, which was greater than the maximum amount of prison time the prosecution agreed to seek under a plea deal with Fogle.
The deadline to appeal was previously set at Jan. 25; Elberger now has until Feb. 19 to file.
