Husband charged in connection to former Martinsville teacher’s sexual assault charges

The husband of a former Martinsville teacher facing charges of molesting at least 10 minors is also being charged in connection to her case. Nicholas Fortinberry is facing a felony intimidation charge, as well as failure to report a crime. 

In an interview with the case’s investigator, the child, who was 13 years old at the time, said Fortinberry threatened him, saying “if you don't stop what you're doing with my wife, then I'm going to kill you in front of your family.” He also is quoted as telling the 13-year-old to stop until he was 16.  

His wife, Brittany Fortinberry, is accused of drugging and sexually abusing this minor, as well as multiple other male students. In total, she’s facing 29 felony charges, including child molestation, sexual misconduct with a minor, dissemination of harmful material to minors, and contributing to the delinquency of a minor.  

The investigator said he could find no record of Fortinberry contacting child protective services about his wife’s interactions with the victim. 

Nicholas’ court records show he posted bail.
