April 4 update:
Monroe Circuit Judge Valeri Haughton ordered a 10-year sentence for Eric Montgomery on Friday. He had already served two years and 87 days. He will serve this sentence at the same time as his current sentence.

A Bloomington man currently in prison for rape will plead guilty in a second rape case.
A jury convicted Eric Montgomery, 36, on charges of rape, providing alcohol to a minor and obstruction of justice. Indiana University student Avery McMillan, 20, died of a fentanyl overdose at Montgomery’s home in August 2022.
Montgomery recently signed a plea deal admitting to raping a neighbor in Ellettsville a year before McMillan’s death. The agreement, filed Thursday, says Montgomery will serve 10 years at the same time as his current 36-year sentence.
The Monroe Circuit Court Probation Department scheduled Montgomery’s sentencing for later this month.

According to court documents, an Ellettsville woman accused Montgomery of sexually assaulting her on Aug. 21, 2021.
The woman reported the rape to Ellettsville police the same day and submitted a sexual assault evidence collection kit to the state crime lab in Indianapolis.
She identified Montgomery as her next-door neighbor and said she allowed him into her apartment because he was distraught about the death of a family member.
According to the victim, Montgomery asked for a hug and to lie with her in bed. The victim consented to the hug, but Montgomery began sexually assaulting her despite her telling him to stop multiple times.
The state crime lab confirmed Montgomery’s DNA sample matched the evidence.
